Judge Barbara Lynn has denied class action status on a claim made by people who had tickets to Super Bowl XLV, but were unable to sit in their seats due to an inability to finalize temporary seating at the stadium. According to Justice Lynn, the class represented was too small and the damages suffered by each claimant could vary wildly, making it best for individual plaintiffs to bring suit against the NFL.
Attorneys for the plaintiffs were seeking a full refund of ticket prices for each member of the suit along with economic damages resulting from travel, time off work, lodging, and related expenses. The NFL has offered ticket holders who did not get to see the game compensation for many of these things already, but the class action suit would have sought to increase the award for participating claimants.
