Cases We Have Handled

Some of the cases we have handled include:

  • Hardy v. Sears – Cook County multi-state class action to establish responsibility of Sears for warranty and negligent home improvement by independent contractors Sears sent out to people responding to Sears ads. Contractors had gone out of business. Co-lead. Settled.
  • Allen v. AT&T – National Class Certified for overbilling. Class certification approved by Oklahoma Supreme Court, Petition for Certiorari to U.S. Supreme Court by AT&T was denied. Settled.
  • Rubel v.Pfizer – Claim for improper marketing of Neurontin by manufacturer for uses not approved by FDA and without sufficient scientifically supported testing for claims. Pending. Based on pending whistleblower case.
  • General Motors – Undisclosed substitute of Chevrolet engine for advertised “rocket engine” in Oldsmobile. Northern District of Illinois (class certified). Case tried and settled after trial. (Committee of Counsel)
  • Gordon v Boden – Illinois Chancery and Appellate Court. Contamination and false labeling of orange juice. Illinois Appellate Court decision establishing use of fluid recovery and Illinois state court authority to certify national class applying, Illinois consumer fraud statute applied extra-territorially. Settled. Sole class counsel.
  • Blue Cross – Northern District of Illinois. Class action contesting legality of “medical necessity” clause definition for class of federal employees. Settled. Co-lead counsel.
